Tenant SUES Housing NSW - and WINS!!!

Last August we reported on a tenant who was taking HNSW to the CTTT for their failure to deal appropriately with her anti-social neighbour.

We are pleased to announce that SHE WON !!!

It took 7 months to go through 3 court hearings - the only defence offered by Housing was a handful of fabricated incident reports with incorrect dates and fictitious events. With over 100 pages of evidence against the noisy neighbour, none of which had been acted upon in two years, Housing's position was indefensible.



The tenant reports that it was a long, hard process; emotionally draining but very worthwhile.
"Although you are not allowed to have lawyers at CTTT, Housing still sent along a legally trained representative who did his best to intimidate, badger and bully me. Even so, I do believe I got a very fair hearing; the Tribunal Member read all the papers and asked all the right questions. In the end the evidence spoke for itself."

The tenant was awarded a refund of part of her rent for the two years that she was subjected to unreasonable noise and anti-social behaviour shattering her right to quiet enjoyment of her property.

"It was never about the money" says the tenant, "I just needed to send a very clear message to HNSW that they can't treat us like this - and a clear message to the Ferals; your behaviour is NOT acceptable."

"I would like to encourage every tenant, in every state, to put their Dept of Housing on notice - we are NOT going to take this anymore."


UPDATE April 2011: The rental refund awarded from the CTTT was delivered to the tenant concerned and promptly forwarded to other non-profit, underfunded Tenant Support Services and Networks as acknowledgement of the wonderful unpaid work they do to assist tenants in need.

Anonymous:This is encouraging but the dept is still failing to do its job!I have been in my property and have never had an inspection!!I live near drug dealers and the dept are aware of this but still they contnue their drug trade while the rest of us suffer from the ferals entering the area to buy their drug. the ferals give all of us living in social housing, a bad name and we are therefore judged by the community for their actions. I had a police officer tell me once.... people in dept of housing are SCUM!!!!! Kick the ferals out. Let them live in the outback suburbs where there is nothing. Let us good tenants occupy the homes.

    2. god the hell i went through in 2009 at stainforth court new town with housing the police and lyn thorp,its was a living hell nightmare im still suffering the pain and anxiety because of all the hell and antisocial behaviour and discrimination by housing tas and tas police.

  2. This is the best thing I have EVER heard in regards to the Department of Housing. Hopefully this will get the ball rolling in all of the other situations with "anti-social" neighbours and all of the good, law abiding tenants who have to put up with them. I just want to say a great big Thank You to this lady who took on the DOH and won, you have given me some hope. God bless you!

    1. I'm so glad she did that and won. I've had death threats, throwing beer bottles in my yard. Glass everywhere abusive screaming outside my house and property damage. I reported it to housing when after 3 police reports nothing changed. Client Service Officer was sympathetic to start however on interviewing my neighbour told me her story was different from mine and there was nothing more he could do. Today she actually yelled out ' so your plan with Housing didn't work and I'm getting my mob from Moree to come down. I rang and told the cso this yet treated me like a piece of scum. I'm not racisit but this mob mentality is disgusting behaviour. I'm seeing Legal Aid to get an AVO and a personal one. I can't believe they refuse to do nothing. Ppl don't change their ways unless there's consequences. There's none because the drunken abusive neighbour is aboriginal. Im 62, very ill and live alone with no family or support. I was one of the many kicked out of Millers Point in Syd and thought Redfern would be fine however I had no knowledge of the small minority of ppl who are out of control. I think with 3 police reports , photos of the damage and 2 death threats more could have been done. Housing don't care and in 17 years in housing I've had no complaints yet this neighbour has many.
      And the CSO didn't know who to believe.

    Wish there were more people who had the time and energy, to make the DoH accountable for the way in which they treat decent tenants.I'm fed-up with them rewarding bad behaviour. The majority of us are decent living people and deserve to live in a safe place. Thank you.

  8. Congratulations May you now be able to live in peace and harmony. And to everyone else this shows what we can AND should do, just because we are housing tenants does not mean that we have given up our rights. This lady has inspired me into finally standing up to housing and asking for my rights. I have had 9 years of anti social neighbors and its time to say ENOUGH is ENOUGH.

I have been in and out of court with an extremely anti-social neighbor for the last 3 years!!! he has freelegal(gay activist group arranged) as he is openly gay, So I had 2 get a lawyer and am now thousands in debt.Even though i won my case he continued 2 harrass for the next12mths b/4 police moved on the continuous breaches!!! they lost on a 'technicality' and now he has escalated 2 a ridiculous degree. I am in a situation were my only choice 4 peace is 2 leave my housing!!!!! Housing Dept. did nothing!!!!!I'd love the name of her advisor as she obviously didn't have a lawyer!!

I had a bad neighbour that verbally harassed me, vandalised my car and made my life of misery and no matter how many complaints I made It made no different it was her word against mine...I even applied for mediation to sort it out, but when it came to it she said no, and that was it cased closed!!and yep she used her race and got out of everything! I called the police, and I was told I needed to get video surveillance to get proof!

  14. this story has given me the inspiration to take action and take housing nsw to court. I lived in a complex of 12, and i know of 5 tenants putting in for a transfer on the grounds that we had a middle eastern gang living at the complex, dealing drugs, violence, abuse, they were using intimadating tactics to other tenants, my family were assaulted by these criminals, police were constantly raiding the premises... housing had hundreds of complaints, but they couldnt evict. we all lived in fear. I was on a 2 year priority transfer, i could not live in fear anymore so i packed my stuff, grabbed my kids and moved interstate. at present time i dont have my own place, i share a room with my 4 kids. Apparently these criminals still live there and no other tenants were transferred, they are still all living in fear for their lives. it was a living nightmare living in the ghettos of greenacre...

  16. my neighbour has rang the police over nothing got an event number and now says she is taking out an AVO. What for. I aksed the police about how people can be charge for making false claims, and he said oh they can but we must take every claim seriously. We have done nothing wrong. This woman is going to tribunal, and is making up stories.

  17. I had a mentally ill next door neigbour screaming on her balcony about me for the last 18 months. She has a fixation about me, that I have installations in her house, out to get her and her family, paranoia, hearing my voice 24/7 in her head mocking her and thought control. For the last 6 months I have been calling the police, last incident one week ago, especially after her death threats that resulted in an AVO which meant nothing as she's sick right? finally mental health services got involved after I begged them that I can't live next to this madness. Yesterday I found out the quiet of the last 5 days was due to her being committed in a mental hospital for treatment/schizophrenia. I dread of the day this neighbour coming back as I have heard from her previous neighbours that when she comes back things will get worse. Still housing wont transfer me stating 2 year minimum wait, even though I am on priority list for unsafe house. My family will never be the same people we were once. Mutual swap - no body intrested.. tried everywhere... Any advice as to what I should do??

  18. reading these stories makes me feel blessed that I live in a small complex of 14 2 b/room units in a lovely town in the northern rivers. We have had one nightmare neighbour in 20 years and luckly for us she had more and more children and was rewarded with a large house far away from us. I was the only one here that ever tried to do anything about her, every one else was too scared and the DHS process is in favour of the scumbag, not the decent tennant. All I can say is write letters to everyone you can think off, local member, Minister of DHS, local paper, any minister with anything to do with health,housing,children. Be as annoying and noisy as you can and ask questions in your letter because they have to reply to questions. They can ignore a rant but not a question, they have to answer and if they don't write again.

I have reported my noisy swearing neighbours on numerous occassions, I have been told I can't transfer from here without proof, they want me to call the police, and get records of it, the police have enough to do, without coming here every day to my house, and it would make it worse if the neighbours get the chat by police all the time, I already get called a f en dog now because one of my neighbours stole from me, and I contacted police, she stole to support her drug habit, my power tools worth around $500, I could not have her charged as the people she went to would not make a statement to police, as they were selling drugs, I have contacted my local member and they are trying to help me, but my lady in my area office doesn't care, she just says to call the police, OMG Sue

  20. Great news there is a light at the end of the tunnel after all. I have been putting up with dangerous neighbors, death threats, threats of rape all reported to the Police for years. Of course DOH dose not a thing, I am taking one to court for AVO next week, it seems that it will never end. All the drug deals have so many rights, I just feel like a speck in the ocean, but I am just holding in.

Gee a lot of story's the same, i have got drug dealers ex junkies dogs barking shouting etc, just goes on and on, the doh just tell me (You choose to live in government housing)Look at the results here one good outcome ( no mention of what happened to the bad tenants). Getting to be similar to USA ghettos.

  22. It would of use to your readers if you published the link to the CTT judgment so that people (I) may see the reasons why the Tribunal made its decision.

    I have a similar situation and need to be sure of the law before I proceed with any application.

  23. You should be aware that the recent decision of teh CTTT held that the Department of Housing was not liable to a tenent where a neighbour caused the noise

    "It is the view of the Tribunal that the Act does not contemplate that a respondent (Department of Housing) has an obligation to provide quiet enjoyment of the area surrounding the premises, or any obligation or to control the behaviour of other tenants with whom it has residential tenancy agreements, even if it were possible to control such behaviour."

    1. Doyle vs DoH was lodged BEFORE the new Act so the decision was made under the OLD Tenancy Act 1987.

      The new act states:
      Residential Tenancies Act 2010 - Sect 50
      (3) A landlord or landlord's agent must take all reasonable steps to ensure that the landlord's other neighbouring tenants do not interfere with the reasonable peace, comfort or privacy of the tenant in using the residential premises.

Congrats to the lady that took doh to the tribunal and won.I told my cso i will be taking them to the cttt,and she said I don't have a leg to stand on.I have been beaten 2x,constantly harassed,have no peace,being called a f....ng wog etc..I had to love with all this crap for the past 10 years or more..Wrote a letter to the minister,frank terrezini,he took his time in answering me after 6 months or so.Then i got a letter from one of his staff saying that doh is taking my matter seriously and as soon as there is a vacant 2 bedroon place they will let me know..I have been on priority since 2008.A young woman from my complex had 4 transfers in 4 years...WHY,HOW??? simply..she has someone in the office helping her...Fair!!?? Taking this matter as far as it needs to go...We should all get together,form a group and take it to the cttt...

  25. wish i hadseen this earlier, we have a violent family in our street, kick in doors to homes, roam the streets stealing and abusing people set fire to cars,we constantly live in fear of thesebullies call police for damages and complaints, do all the paper work all the video evidence tell housing and police and still they live here, took them to court for avos,was asulted in court house and still they live in our street, constantly harrass all who live in the street. nothing is ever done, now i might have a reason to sue with a chanceof the housing doing their job and restore our peace and safety

    1. Hi Joanne,
      You obviously have a computer. It's a great tool. Get your local Housing office email address - an individual's email is even better ( your client service officer or complaint officer) and start documenting all incidents. Keep a diary, and at the end of each week - email a list of all the incidents WITH DATES AND TIMES (very important). In the subject area of the email write "CONFIDENTIAL" (to protect you) with the name and address of the Offender. Make sure you speak to your client service officer (or the officer dealing with complaints) about the tenant before you start reporting the incidents via email, but don't necessarily tell him/her your intensions, and end your conversation with: I should report all incidents to you then? When they say yes -you are in business. THEN commence your email with: As requested I am reporting the following incidents which occurred week commencing ....at .... by tenant .....(again this method is to protect you). End with -I refer to sect 50 of the new act which states:
      Residential Tenancies Act 2010 - Sect 50
      (3) A landlord or landlord's agent must take all reasonable steps to ensure that the landlord's other neighbouring tenants do not interfere with the reasonable peace, comfort or privacy of the tenant in using the residential premises.

      Make sure you include your full name at the bottom (sign off yours sincerely -yours truly etc). In this form -I am fairly sure that they cannot ignore your complaint. In any case, you will have an excellent record of your complaint should you need to take the matter further. BTW -if you can - print out the complaint, take it into the office - request that they stamp it with a received stamp and ask them to make you a copy. Keep this copy in a folder.

Having read the article about the "Tenant takes on HNSW & WINS" it doesn`t cease to amaze me as to WHY virtually no-one wants to put their name to all of these comments,even though they feel the need to express what is going on with their lives,if everybody got off their backsides & we all UNITE about the injustice`s of the system,just like this one woman has done,MAYBE just MAYBE we might have some JUSTICE for the UNDERDOG !!!!!!

  27. I also have a violent and noisy 'junky' neighbour who makes life hell for the rest of her neighbours. Why is it that Housing NSW won't hesitate to take a tenant to the tribunal if they are $35 (that's right $35) behind in rent - it happened to me and I pay the market rate and struggle to meet bills... I think I may have the answer: because as soon as a tenant is late with money an automated letter is printed, and the process flows from there. What is needed here to deal appropriately with serious offenders - where police have been involved and a report made to Housing, is a system of reporting in place that Housing staff must use which will generate an automated letter to the offending tenant. This system is in place, if a tenant is behind in payments therefore it would take very little adjustment for Housing's I.T. Department to instigate this system which will bring Housing up-to-date with its obligations under section 50 and protect tenants. If police are involved and have an incident number then that should be sufficient to immediately bring the tenant before the tribunal.

  28. What a joke... Why are the people that do not do their job properly still employed by the government? Why are good tenants that are not involved in anti social behavior being punished for trying to stay safe and not have their homes broken into? Why is it that doh employees give verbal permissions and renig on their word if a complant is made that's false ? If a normal business had conflicting policy like doh does it would be shut down. Great job they think its a joke how they do what ever suits them.

Some people in my block do not pay rent at all a i know of one such person that has done this also the other so called tennat of this property has not told them to get out and the police have been there a number of times.and as a tennant i feel that this person/s should have their tennancy terminated .

  30. im in the same situation with a noisy neighbor after a year of getting rid of the old one constant drug dealing fights and even stabbing's have occurred only to be told that if I want anything done I have to face them in the tribunal otherwise they cant do anything because I wont give evidence.It so unfair that you must be put in a situation where your risking your safety just in the hopes that they will even do anything and if they don't you have to deal with a horde of junkies with the ''snitches get stitches mentality'' surely there has got to be a way for them to enforce their rules without putting you in harms way it just makes no sense anyone else have this problem or any advice ? as a 22 yr old female i feel to scared to do anything if it involves me disclosing my identity especially when its a house full of drug dealing men whom ive seen first hand stab another person before my very eyes

    1. I had the same problems with a drug house across the road. Forget doh and deal directly with police. find out when drop is being made and call them as soon as it is. Got rid of my lot.

  31. dewayne I need to be contacted by someone who knows about or has dealt with housing and tenAnts living in CONTAMINATED PROPERTIES my mother is living in a property that is a level 3-4 building contamination she has spent over 2000 dollars on testing which she has taken to the tccc she has documented health reports stating the living conditions are affecting the whole family the youngest being a mnth old atm can anyone help me plz my mum is fighting her heart out and seems to be getting no where who can help either with a way to deal with housing not acknowledging the seriousness of the testing results or create attention so that other tenants living in the same conditions are aware someone is standing up and has the microbiological proof that these properties are unsafeand well below building code regulations as well as health code regulations we need urgently someone to do a building inspection based on poor air quality and hidden mould-mildew in the buildings inner structure plz help

    1. have this problem too. get certifates of health problems caused by housing. complain officially, then threaten to go to ombudsman =, current affair and if necessary to take minister to court. Resitec is now coming in a couple of weeks to do them up. I also had the dp. assets officer out to view and he agreed with me 100% and lodged an application for money,. They do have a duty of care and I said I would only pay half rent until place is fixed??? These are a bock of 7 seniors units and 4 tenants were coming down with the same illness.

  32. when, if ever will politicians hit the streets and rally with the folks that need all the benefits, and perks, of the monies spent by goverment. Have you hit pavement to speak with people in the department of housing? A public system that has run amuck. What if private persons, had to run to doctors for statements that their neighbor flushing the toilet, or doing dishes interferes with their television program, to give to the mortgage company or landlord, to compel them to stop. Hmm, now that is a drain on the health care system, on would think. The whole department of housing administration offices needs to be cleaned out, and safe gards put in place, erradicate unequal distribution of the the rules, where all in need can actually live in peace. The leases with the department of housing are a farce, a fake, and a fraud. As they omitt from them, there is an sublimentation, and replacement of the the lease written by the tentants. Get out there and speak with the people whom by law, also have to vote. Put an end to the nonfeasances, misfeasance and malfeasance of a department that answers to no one but it's self. What about the people who own their houses and we have a couple of housing comission houses across the road, one is a drug dealer and the other one has about 8 kids running around stealing from peoples letter boxes, riding motor bikes in the vacant padock across the road etc.. nothing is ever done about these people why should i have to pay a mortgage to live across the road from scum like this when there are decent families out there looking for housing....

    Just like to present an example of stupidity regarding maintenance. I became a Housing tenant after being on the waiting list for 18 years with serious health problems and got heartily sick of seeing other persons being housed ahead of me. Long story short, I took Housing to court on a discrimination issue and won the case. Within two weeks we were offered a three bedroom house on a quarter acre sloping section with huge lawns. Due to illness, unable to mow the lawns or carry out section maintenance and was up for $50 p/m to have the lawns cut. The house had relatively new guttering and when I asked for assistance to clean the gutters (which hadn't been cleaned for years) a crew turned up a couple of week later and REPLACED all the gutters and down pipes.......sigh! Not a great application of logic or economics!

    1. Don Quixote de la Mancha - that is a classic story. HNSW have no idea what is going on anywhere within their departments. There is no communication and the money they waste on stories such as yours is a disgrace. They change positions on a regular basis in order to "get rid of" any complaints that are in place. After a couple of years of correspondence etc you will always get a response of "I no longer deal with this area, I have sent your complaint to so and so who now does". They just keep the process going in circles, exhaust the complainant and then start the process all over again. Disgraceful. And then of course in situations like yours, where they act straight away, take no notice of the facts and spend money where it is not needed. Have to wonder if there's some money changing hands really - I mean, any guttering contractor would be aware the gutters didn't need replacing.

I lived in a large complex at woonona NSW, couldn't get a swap at all, even though i had a large beautiful four bedroom house 100metres from the beach, i finally did a pamphlet drop to over 1000 DOH dwellings around the illawarra, with offers to financial help for removalist costs to whomever swapped with me. Eventually i found a tenant desperate to leave her tiny three bedroom house, which was in such appauling condition i was dumbfounded that DOH had even allowed her tenancy, holes in every wall, door in the house, carpet so soaked in animal urine you could not physically sit on it. I took the swap, making me responsible for all repairs, which i did on my own, it cost me in excess of $2000 dollars to repair, and twelve weeks of living out of boxes and moving from room to room to carry the repairs out, every window in the house needed replacing as their were no keys and non functioning, how this woman lived in these conditions is beyond me, it then took two solid weeks in the backyard to remove the broken glass, bricks and wood dumped in hip high grass, DOH were ardamant i pay for the scip bin needed to remove the rubbish i had dragged up the steep driveway and left on the council strip, six metres high by five metres deep and fifteen metres long, thankfully management at DOH heard my anguish at the expected thousands of dollars quoted to remove the former tenants filth and removed it at their expense. I have now been living in my lovely cottage for almost four years, and think it was the best thing i have done, my neighbours are all lovely. As for that beautiful home near the water, it is now in worse condition than this ever was..unbelievable how much is given to the unworthy..

Congratulations your a on your win your a brave woman, it seems like its the only way to get through to them, I have been thinking of taking some action myself, it is just crazy how the DOH waste money on repairs rather than fix their bad tenants, I have lived in a block of 9 units for 10 years and there was never any trouble, until they moved in a couple of feral neighbours one on the 2nd floor the second on the top floor, Our security door has been kicked in so many times,there has been so much damage done to the building since they moved in,they see and control everything that goes on in the building, their doors are always open and everyone who is not connected to their drug dealing or part of their violent visitors are too scared to walk out their front doors most days,the dept does nothing about them because they say they can't. Calling the police just brings retaliation on the good tenants, they steal our mail dump rubbish outside our doors we feel completely vunerable, its like their above the law.

    Ironically, the Newman Govt grandstanding manifested within the "three strikes and you're out" policy as Housing Minister Tim Mander insisted that "the new policy would see problem tenants evicted if they fail to curb their behaviour. At the bare minimum, tenants are expected to refrain from hosting out-of-control parties, aggressive behaviour and vandalism! There is an expectation that tenants won't behave in a way that is disruptive to others in the neighbourhood.     Consequently, Newman Govt's "three strikes and you're out policy" continues to be questioned as many complaints have been made to the Dept of Housing about antisocial behaviour in public housing on Brisbane's northside. I have a similar problem next door neighbours ever since they moved in even before have been harassing me mentally and emotionally i have spent years trying to ignore them going my own business but every day they get worse and worse how can this problem be confronted they have some input in the drug trade in my area on continue to use whatever reasons to make my life harder i am breaking down suicide and other problems is there no justice.

Iv been in housing for about 2 and a half years iv been moved once due to drug dealers and a police seige at a neigbous now i face the same more drug dealers and abuse iv made many complaints called the police who never turned up twice now i have young childern and one of my childern is autistic they can not play outside because of the yelling and abuse and drunken parties everyday im sick to death of being stuck in just another craphole i pay market rent i keep my place clean i can't afford to private rent or buy at this time and after reading alot of these comments i feel that we are all victims that just get pushed aside or fall through the cracks i feel that nothing will change until you get out of doh the scum win.

  41. I too have same problem with housing as these tennats opposite me continue to cause myself disscomford by dealing in substance & foul language,
    I contacted local office in Strawberyhills & no response as they just ignore you.
    This is causing me stress.
    The housing need to be held account able.

  42. Ive lived in Housing for not yet a year. Its a lovely street in a lovely area. Mostly owner occupied homes. However I live next door to a psychopath who is also a housing commission tentant. Its so bad the 2 houses opposite the house next door are now all for sale.These are retirees semi retired or workers. All have complained about her antics but housing has ignored them. Its sad that people who have worked all there lives for their homes and nest eggs have to sell because of this one housing tenant. Im not on good terms with the tenant but there doesnt seem to be anything anyone can do. Any suggestions would be appreciated.

    or with certain amounts of complaints against them together as neighbours and hopefully they get rid of each other
    since these types of creatures don't have respect for anyone else might as well put them together

  44. Advice from local police was to keep a diary of every incident and the time of offences. Also to keep up with my letters of complaint. You have to badger them and if you feel your Housing NSW office isn't dealing with the problem effectively start writing to the Minister. It took me 18 months to be rid of the junkie whose drug deals disturbed our unit block all night most nights. Older tenants choose not to get involved due to fear of retaliation; others who have had their concerns and complaints ignored or not dealt with eventually just give up. It's hard but do persevere but be aware Housing will give up your identity.

I've lived housing for over 3 years now for the past two years I've had to deal with junkies drug dealers and thieves we've had numerous stolen cars towed away by the police. my neighbours don't give two dams about what's going on I've got photos videos I've even found their drugs bongs ice pipes and needles all over the property handed them to the police and housing and still they haven't done anything about it I've had to deal with brutal abuse getting my door kicked dead animals placed at my door shit at my door and I've even got beaten up with fractured rib bones and minor bruising just because I reported them in. I've made numerous reports for these incidents and I've even got the reference numbers for all the incidence even placed for a transfer because I was worried for the safety of my child and they say that my case isn't major enough to get an immediate transfer. On top of that I've made numerous reports from maintenance due to the common area Stairway where I have fallen 4 times the last time I've fallen which was 10 days ago I've broken my tailbone and still housing hasn't done anything for the maintenance. Is there anything else I can do all comments would be appreciated thank you
